Fee and payment agreement: Client agrees to pay total cost of package checked below + any travel fees if needed + any a la carte options selected. A final invoice will be emailed to the client after receiving of this contract. A 30% non-refundable deposit of the selected package is due at the signing of this contact in order to reserve your wedding date and will be deducted from the total due. Final remaining payment is due on the day of your wedding. Cash or checks are acceptable. Venmo and Zelle will no longer be accepted after Jan. 1, 2022 for final payments. Checks should be made payable to Makayla Minyo.

 

Understanding of agreement: This agreement contains the full understanding between Makayla Autumn Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties involved.

 

Reservation: Upon the signing of this contract and the successful depositing of the 30% deposit sent by client, the specified date and coverage will be reserved.

Requirements:

1. Client agrees to send a hard copy of their invitation to Makayla Minyo. (4474 CO. Rd. 98, Mt. Gilead, Ohio 43338) This will allow her to prepare for detail shoots the day of your wedding. For example, colors, theme, and flat lay details.

2. Clients will prepare a wedding day timeline one month prior to the wedding. (Makayla can help with specific details).

3. Clients also agree to create a bride and groom family list for the day of the wedding. This will help make sure I capture all photos requested with your family and friends. 

 

Product Delivery: Delivery dates are always dependent on how busy the season is, and the client must understand that times are estimated. Ideally, the client will receive their online gallery in a max of 6 weeks from the wedding date.

 

Copyrights: Until final payment for services rendered is made, the photographs produced by Makayla Autumn Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Makayla Minyo’s explicitly written permission. Upon final payment by the client, limited copyright ownership of the resulting images will be transferred to the client under the following conditions: I, Makayla Minyo, of Makayla Autumn Photography, am the rightful copyright owner of these digital images. I authorize the owner of these digital images the right to print these files. Original copyright remains with the photographer. The photos may be printed but not altered or edited in any way other than by the photographer and alterations is a violation of the copyright.

Makayla Minyo is not liable for print quality, cropping or coloring of any photos not printed directly through my professional lab. Proper recognition of Makayla Autumn Photography is appreciated and requested when publishing photos and using them online (example, when posting images on Facebook or Instagram please tag, or use given watermark photos). Photos may not be entered into any contest without my prior consent and without proper credit to Makayla Autumn Photography.

 

You may:

• Download images from Pass Gallery as it is your right after signing print release form

• Share the images I post on social media sites for your own personal social media sites or tag yourself in images that are of your family/children.  You may also use those images as your cover photo or profile image.

• Use the images from your session on your own personal websites or social media websites (a photo credit is required.)

• Use the high-resolution digital images from your session to reproduce prints. I recommend consumer sites like your online gallery, mpix.com or nationsphotolab.com.  I do not recommend big box chain stores like Walmart, CVS, Costco, Target, Walgreens, or Sam's Club.

You may not:

• Copy images from this website or from my social media sites with the intent to alter, crop, remove watermarks, edit, or claim as your own.

• Alter or re-edit my images.

• Print images from my website or from social media sites.

• Use any of my images for publications or promotional purposes without knowledge.

 

Cancellation: In the event Makayla Autumn Photography’s services are canceled by the client, or the event is canceled, 30% deposit will not be returned. If the date is changed within 3 months after booking, the deposit cannot be transferred to a new date as the deposit prevents Makayla Autumn Photography from scheduling another job on selected date. A completely new deposit and contract must be given. In the event of an unexpected scheduling conflict for the photographer, Makayla Minyo will return all money paid in advance and find a replacement photographer of equal skill and style type. In the unlikely event of an emergency or other unforeseen circumstance (COVID-19) that may prevent Makayla Minyo’s ability to perform, any money given will be returned to the client. Makayla Minyo will do everything she can to find a completely capable and professional replacement, no further liability will be claimed by Makayla Autumn Photography at that point.

 

House Rules: The photographer is limited by the guidelines of the ceremony official of reception site management. The client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for modification of guidelines is the client’s responsibility. Makayla Petersen will offer technical recommendations only.

 

Meals: Client agrees to provide a vendor meal for Makayla Minyo and any second photographer or assistant with her. The photographer and assistant(s) will be given the chance to eat during the reception and will be careful not to eat at a time that will interfere with documenting important events during the reception.

 

Cooperation: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. The photographer will not be held accountable if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Makayla Minyo. Makayla Autumn Photography is not responsible to seek out specific individuals or items for special desired photos – this is to be done by the client or by an individual designated by the client in order to properly communicate and organize any specially desired photos. If for some reason, an outside party in unhappy with any of the photos produced, Makayla Minyo cannot be held responsible for their request or complaints, as the photographer’s main goal is to please and satisfy the signers of this contract. No outside parties should be contacting Makayla Minyo with desired revisions or complaints, Makayla Minyo will work directly with the signers of this contract if any changes are indeed needed to be made.

 

Traveling Fees: For 2023 weddings and beyond this date, all wedding collections will include all travel fees​. The client agrees to compensate Makayla Minyo for overnight or out of state traveling if needed. Travel by air will require additional compensation including lodging and food costs. Specific traveling arrangements will be discussed on a case by case basis.

Model Release: Makayla Minyo has the right to use and publish photos of the event for any purpose thought proper by Makayla Autumn Photography, such as advertising, display, website, marketing purposes, etc. This includes but is not limited to Facebook, Instagram, Pinterest, and any business materials, handouts, samples, etc.

Photo Adjustments: If absolutely needed, minor specific requested adjustments (i.e. -cropping, black and white, resizing, etc.) can be made to images for specific purposes. However, official delivered images are to be considered final artwork and have been done to the absolute best ability and expertise of the photographer. Editing style cannot be changed or adjusted according to client preferences. By signing this contract, you are accepting and deferring final product expertise to the photographer.
